Welcome to Qailly, the app testing platform. These Terms of Service ("Terms") govern your access to and use of our services. By creating an account, submitting reviews, or using any part of our platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
1. Acceptance of Terms
By accessing or using Qailly, you confirm that you accept these Terms and agree to comply with them. If you do not agree with any part of these Terms, you must not use our platform.
2. Eligibility
To use this platform, you must:
- Be at least 18 years of age or the age of majority in your jurisdiction
- Have a valid email address and phone number
- Provide accurate, current, and complete information
- Have the legal capacity to enter into binding contracts
- Not be previously banned or suspended from our platform
- Comply with all applicable local, state, national, and international laws
3. User Accounts
Account Registration:
- You must create only one account per person
- Multiple accounts are strictly prohibited and will result in immediate termination
- You are responsible for maintaining the confidentiality of your account credentials
- You must notify us immediately of any unauthorized account access
- All activities conducted through your account are your responsibility
Account Security:
- Never share your account credentials with anyone
- Use a strong, unique password
- Log out from shared or public devices
4. Prohibited Conduct: Fake Reviews & Account Banning
⚠️ CRITICAL WARNING
Submitting fake, fraudulent, or dishonest reviews is strictly prohibited and will result in IMMEDIATE AND PERMANENT ACCOUNT TERMINATION with no prior warning.
What Constitutes a Fake Review:
- Not actually testing the app: Submitting reviews without downloading or using the app
- Using fake screenshots: Using screenshots from other sources, AI-generated images, or manipulated content
- Copying reviews: Plagiarizing or copying reviews from other users or the internet
- Generic/templated content: Using copy-paste templates without genuine testing
- Fabricating experiences: Making up bugs, features, or experiences that didn't happen
- AI-generated reviews: Using AI tools to write reviews without actual testing
- Rushed submissions: Submitting reviews within seconds or minutes without adequate testing time
- Screenshot inconsistencies: Screenshots that don't match your device, time zone, or claims
Consequences of Fake Reviews:
- Immediate account termination - No warnings given
- Permanent ban - You will not be allowed to create new accounts
- Forfeiture of all pending payments - No compensation for fake reviews
- Legal action - We reserve the right to pursue legal remedies for fraud
- Blacklist from platform - Your email, phone, and device ID will be permanently blocked
💡 Remember:
We value honesty and authenticity. Take your time to genuinely test each app, provide thoughtful feedback, and earn legitimately. Your long-term earning potential is much greater with honest reviews than trying to game the system.
5. Review Guidelines
What We Expect:
- Spend at least 10-15 minutes genuinely testing each app
- Provide honest, detailed, and constructive feedback
- Include authentic screenshots from your actual testing
- Write in your own words based on your real experience
- Cover multiple aspects: UI, functionality, bugs, and overall experience
- Be respectful and professional in your language
Quality Standards:
- Reviews must be at least 100 words with meaningful content
- Include 2-5 clear, relevant screenshots
- Screenshots must show actual app usage, not just download pages
- Avoid offensive, discriminatory, or inappropriate language
- Do not include personal information of others
6. Payments & Earnings
Payment Terms: You will earn the specified amount per approved review. Payments are processed after review approval and verification.
- Only approved, genuine reviews are eligible for payment
- Payment rates vary by app and are displayed clearly
- Daily review limits apply per app to ensure quality
- Rejected or fake reviews forfeit all payment rights
- Minimum withdrawal amounts may apply
- We reserve the right to withhold payment for suspicious activity pending investigation
- Banned accounts forfeit all pending and future payments
7. Intellectual Property
Content Ownership: You retain ownership of the reviews and content you submit. However, by submitting content to our platform, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content for platform operations and app developer feedback.
Platform Content: All platform materials, including logos, designs, text, graphics, and software, are owned by Qailly and protected by copyright and trademark laws.
8. Account Moderation & Termination
We enforce a tiered moderation system to maintain platform integrity. Violations result in escalating consequences:
⚠️ Warning Status:
- Issued for minor policy violations (e.g., submitting old screenshots, suspicious activity)
- You can continue using the platform and submitting reviews
- You cannot withdraw funds while warned
- Further violations may result in restriction or ban
🚫 Restricted Status:
- Issued for multiple violations or more serious infractions
- Your account access is limited
- You cannot submit reviews, complete actions, or withdraw funds
- This is recoverable - Contact support to appeal the restriction
- Admins can restore your account to active status after review
⛔ Banned Status:
- Issued for severe or repeated serious violations (fake reviews, fraud, multiple accounts)
- This is permanent and cannot be appealed
- You lose all access to the platform immediately
- All pending balance may be forfeited
- You cannot create new accounts on Qailly
- Your email, phone, and device may be permanently blacklisted
Reasons for Moderation Action:
- Violation of these Terms of Service
- Fraudulent activity or fake reviews
- Multiple account creation
- Abusive or harassing behavior
- Submitting old or manipulated screenshots
- Gaming the system or attempting to exploit platform features
- Any conduct that harms the platform or other users
We reserve the right to take moderation action at any time, with or without notice. All decisions are made to protect platform integrity and the community.
9. Limitation of Liability
To the fullest extent permitted by law, Qailly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the platform.
10. Dispute Resolution
Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the laws of Kenya. You agree to waive any right to a jury trial or to participate in a class action.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.
11. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes via email or platform notification. Your continued use of the platform after such modifications constitutes acceptance of the updated Terms.
